By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Site on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
You must be at least 18 years of age to use this Site. By using the Site, you represent that you are at least 18 years old.

Certain features of the Site, including the Trident Pool Club membership program, may require you to create an account. When you create an account, you agree to:

- Maintain and promptly update your account information to keep it accurate and complete.

- Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms or for prolonged inactivity.
6. Membership Program
Trident may offer a membership program (the "Trident Pool Club") through the Site. The Trident Pool Club is a loyalty and discount program. It is not a service contract, warranty, or insurance product.
If you enroll in the Trident Pool Club, your membership is governed by the separate Membership Terms and Conditions, which are incorporated herein by reference. In the event of any conflict between these Terms of Service and the Membership Terms and Conditions with respect to membership-related matters, the Membership Terms and Conditions shall control.
Key membership provisions, including auto-renewal terms, cancellation policy, discount caps, and benefit limitations, are set forth in the Membership Terms and Conditions. Please review those terms carefully before enrolling.
7. Service Agreements
The Site provides information about Trident's pool maintenance, repair, and related services. Information presented on the Site, including service descriptions, pricing ranges, and scope of work, is for general informational purposes only and does not constitute a binding offer or service agreement.
All pool maintenance, repair, equipment installation, and related services are governed by separate written service agreements executed between Trident and the client. The terms of any executed service agreement shall supersede any conflicting information presented on the Site.
Regulatory information:
Any information on this Site regarding pool regulations, health department requirements, compliance obligations, or similar regulatory topics is provided for general educational purposes based on Trident's understanding of applicable laws and regulations. This information does not constitute legal advice. Property owners and managers should consult with qualified legal counsel and the appropriate regulatory authorities to confirm the requirements applicable to their specific properties and circumstances.
8. Intellectual Property
The Site and its entire contents, features, and functionality, including all text, graphics, logos, images, photographs, videos, page layout, design elements, and software, are owned by Trident Aquatic Services, LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Trademarks:
"Trident Aquatic Services," the Trident logo, "Pool Care You Can Count On," "Trident Pool Club," "Trident Pro Alliance," and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Trident Aquatic Services, LLC. You may not use these marks without our prior written permission.
All other names, logos, product and service names, designs, and slogans displayed on this Site are the trademarks of their respective owners. The display of third-party trademarks on this Site does not imply endorsement, sponsorship, or affiliation with Trident unless expressly stated.
Limited License:
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. This license does not include the right to:
- Modify, copy, or create derivative works based on the Site or its content.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRIDENT AQUATIC SERVICES, LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to, use of, or inability to access or use the Site;
- Any conduct or content of any third party on the Site;
- Any content obtained from the Site; or
- Unauthorized access, use, or alteration of your transmissions or content,
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
In no event shall Trident's total aggregate liability to you for all claims arising out of or related to the Site or these Terms exceed one hundred dollars ($100.00) or the amount you have paid to Trident in the twelve (12) months preceding the claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by law.
This limitation of liability applies solely to your use of the Site. Liability related to pool maintenance, repair, or other professional services provided by Trident is governed by the applicable service agreement between you and Trident, not by these Terms.
12. Indemnification
You agree to indemnify, defend, and hold harmless Trident Aquatic Services, LLC, its members, managers, officers, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Site.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Your violation of any rights of any third party.
- Any content you submit or transmit through the Site.
13. Third-Party Links and Content

14. SMS and Communications Consent
By providing your telephone number through the Site and consenting to receive SMS messages, you agree to receive text messages from Trident Aquatic Services related to your inquiry, quote request, scheduled service, or account. Message frequency may vary. Message and data rates may apply.
You may opt out of SMS communications at any time by replying STOP to any message. For assistance, reply HELP or contact us at hello@tridentaquaticservices.com. Opting out of SMS communications will not affect any other services you receive from Trident.
By subscribing to our email newsletter, you consent to receive periodic emails regarding pool care tips, seasonal guidance, service updates, and information about Trident programs, including membership and promotional offers. You may unsubscribe at any time using the unsubscribe link included in every email.

15. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Site, you consent to the collection and use of information as described in the Privacy Policy.
16. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or related to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.
Informal Resolution:
Before initiating any formal legal proceeding, you agree to first contact Trident at hello@tridentaquaticservices.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any concern or dispute within thirty (30) days of receipt of your written notice.
Jurisdiction and Venue:
If informal resolution is unsuccessful, any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Davidson County, Tennessee. You consent to the personal jurisdiction and venue of such courts and waive any objection to the convenience of such forums.
Waiver of Class Action:
To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
18. Entire Agreement
These Terms, together with the Privacy Policy and the Membership Terms and Conditions (if applicable to you), constitute the entire agreement between you and Trident with respect to your use of the Site.
These Terms do not alter or supersede any separate written service agreement, proposal, or contract between you and Trident for pool maintenance, repair, or other professional services. In the event of a conflict between these Terms and any executed service agreement, the service agreement shall control with respect to the services covered by that agreement.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of Trident.
